In this cause it appearing from the Order of Publication, of  the resident of the  Defendant, the UNKNOWN FATHER OF JACOB WHITED, cannot be ascertained upon diligent inquiry. It is hereby ordered that publication be made for four (4) consecutive weeks, as required by law, in the Jasper Journal, a newspaper published in Marion County, Tennessee, notifying the Defendant, the UNKNOWN FATHER OF JACOB WHITED.

The Defendant, the UNKNOWN FATHER OF JACOB WHITED, to file an answer with this court and a copy to Plaintiff’s attorney, Jennifer Mitchell, whose address is P.O. Box 666, Dunalp Tn. 37327, within 30 days from the last date of publication, exclusive of the last date of publication, or a judgment by default may be entered and the cause set for a hearing ex parte as to said Defendant. WHEREAS, default having been made in the payment of the debts and obligations secured to be paid by that certain Deed of Trust executed the 19th day of October 2007, by G. Larry Wells to Milligan Reynolds Guaranty Title Agency, Inc. of Tennessee, Trustee, as the same appears of record in the Office of the Register of Deeds in Marion County, Tennessee, in Book 394, beginning at Page 119, as modified by Modification of Deed of Trust executed the 19th day of October 2012 and recorded at Book 443 beginning at Page 457 in said Register’s Office, to which reference is hereby made; and

WHEREAS, the undersigned, Wade K. Cannon, was appointed as Substitute Trustee under said Deed of Trust by instrument recorded in Book 482, beginning at Page 1633, in said Register of Deeds Office; and

NOTICE OF FORECLOSURE

 

WHEREAS, by Deed of Trust dated August 10, 2005, of record in Book 360, page 784, Register’s Office of Marion County, Tennessee, HARRY RUBI AND ROSA RUBI, HUSBAND AND WIFE, did convey unto T. Mike Estes, as Trustee, a certain tract of real estate hereinafter described, to secure a certain indebtedness set out in said Deed of Trust; and

WHEREAS, FARM CREDIT MID-AMERICA, FLCA (FORMERLY FARM CREDIT SERVICES OF MID-AMERICA, FLCA), is the owner and holder of the note secured by said Deed of Trust hereinabove referred to; and

WHEREAS, said Deed of Trust was made to secure the payment of a note therein set out and contained the power to sell in the case of default in the payment of said note and interest at maturity; and

WHEREAS, the makers of said note have defaulted in the payment thereof, and the owner and holder of said note has declared the entire amount due and payable and has requested the undersigned to foreclose said Deed of Trust according to its terms in order to collect said note.

WYATT BURK, SUBSTITUTE TRUSTEE will, in accordance with the terms set out in the Deed of Trust above referred to, on October 21, 2016, at 11:00 A.M., at the door of the Marion County Courthouse, offer for sale and sell the above-described real estate at public auction to the highest and best bidder for cash in bar of equity of redemption and free from homestead and dower, all in accordance with the provisions of said Deed of Trust and the laws of Tennessee controlling such sales, subject, however, to all outstanding real estate taxes; any applicable easements and restrictions; and prior liens or mortgages, if any Other interested parties:  Jefferson Smurfit Corporation Said property may be sold as a whole or by individual lots or tracts or groups of lots or tracts at the discretion of the Substitute Trustee.

The right is reserved to adjourn the day of the sale to another day and time certain without further publication and in accordance with law upon announcement of said adjournment on the day and time and place of sale set forth above.

The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Substitute Trustee, be cause for rejection of the bid, and if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms thereof.  The proceeds derived from the sale of the property will be applied as provided for in said Deed of Trust.  Said Deed of Trust is made a part hereof as if copied verbatim herein.

 

This sale of the Property shall be subject to any and all taxes, easements, restrictions, building lines, and assessments (plus penalty and interest, if any), and any redemptive rights of any governmental agency, State or Federal (including redemptive rights of any taxing authority by reason of any tax liens), plus any and all other matters and encumbrances superior in right to the lien of the Deed of Trust, as well as any priority created by fixture filing, and any applicable City and/or County zoning ordinances as now affect or as may later affect the parcel.

If the U. S. Department of the Treasury/Internal Revenue Service, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor and Work Force Development are listed as interested parties in the advertisement, then the notice of this foreclosure is being given to them, and the sale will be subject to the applicable governmental right to redeem the property, all as required by 26 U.S.C. 7425 and T.C.A. 67-1-1433.

If applicable, the notice requirements of T.C.A. 35-5-117 have been met.

The address of the property is known unknown, but such address is not part of the legal description of the property sold herein, and in the event of any discrepancy, the legal description herein shall control.  This property is further identified as being Map 136, Parcel 3.02, on the records of the Tax Assessor of Marion County, Tennessee.

NOTICE OF COAL MINING RENEWAL 

APPLICATION

 

Tennessee Consolidated Coal Company, 1000 Pocket Road, Whitwell, Tennessee 37397, has submitted to the Office of Surface Mining (OSM) an application to renew permit number 2475 in Marion County. The existing Preparation Plant site to which this permit applies is situated on Dogwood Flat just south of the community of Griffith Creek, Tennessee as shown on the Palmer Quadrangle (99-SE). The property in this area is owed by Tennessee Consolidated Coal Company. Access to the area is off Pocket Road (off Highway 108) in Northwestern Marion County. This application is available for public review at the Marion County courthouse between 8:00 a.m. and 4:00 p.m., Central Time, and at the OSM Knoxville Field Office between 8:30 a.m. and 3:30 p.m., Eastern Time, on normal workdays. During this public review period, from September 20, 2016 to November 10, 2016, OSM will accept written comments, objections, or requests for an informal conference relative to this application. Any person having an interest, which is or may be adversely affected by the decision on the applications, may make such written comments during the pubic review period. Persons requesting an informal conference will provide the information specified in 30 CFR 773.6(c). Written comments are requests for an informal conference are to be submitted to the OSM Knoxville Field Office, Technical Group, 710 Locust Street, Second Floor, Knoxville, Tennessee 37902. In making comments, refer to the permit number.
